Realizing Agenda 21: A Nigerian Perspective

During the 1992 United Nations Earth Summit in Rio de Janeiro, Brazil, 178 countries adopted Agenda 21 as a non binding global environmental plan for sustainable development.The document underscored the important role of States in the implementation of sustainable development at the national level and also serves as a blueprint for governments in the implementation of sustainable development.This work examines the implementation of sustainable development in Nigeria within the framework of Agenda 21. It suggests inter alia that corruption and insufficient public participation are some of the major obstacles to the implementation of the sustainable development objectives of Agenda 21 in Nigeria. To enhance the realization of the objectives of Agenda 21 in Nigeria, the author recommends inter alia the establishment of a constitutional right to sustainable development alongside inter generational rights and the recognition of the public trust doctrine as well as the adoption of budget analysis. This work will be useful to Students of development law.It will also be of interest to any person interested in learning about the implementation of sustainable development in Nigeria.

Ever since the adoption of the Forest Principles and Chapter 11 of Agenda 21, the sustainable use of forest ressources has been a key issue. Since then, constantly increasing public demand on forests requires contemporary management solutions. Especially in protected areas, which are suffering under increasing human pressure, forest managers are facing the great challenge of finding the right balance between social, environmental and economic benefits, without harming the fragile and ecologically sensitive environment. This study evaluates the multiple forest use in an IUCN Category V protected area with special attention to non-timber forest products and forest- based services and activities (recreation, hunting and game management, forest conservation, forest ecosystem services e.g). The study provides a detailed description of the main user activities and the current geographic, institutional, legislative and socioeconomic framework conditions. It also gives an overview on the srengths, weaknesses, opportunities and threats that the protected area mangement is faced with.

Environmental Impact Assessment (EIA) has been in existence throughout the 1970's and 1980's where international treaties began to impose EIA requirements that were broad and more detailed. Presently EIA has become an aspect for both domestic and international environmental law, making states not to undertake activities without prior consideration of their environmental effects . Chapter 22 of Agenda 21 and article 8(h) of the statement on forests similarly proclaim the necessity to assess the environmental impact of certain planned activities. Article 14(1) (a) and (b) of the Convention on Biological Diversity treats both the national and international aspects of the issue. Principle 17 of the Rio Declaration extends the rule of prior assessment of potentially harmful activities to include those activities, which have impacts within a state. Uganda has signed and ratified all of these treaties, which it must enforce. It is rather a field of knowledge in which a plurality of practices, concepts and theories are developed. Thus, there exist numerous disciplinary subdivisions and research programmes within the field, the boundaries of which remain blurred. As a consequence, the deliberation to adequately identify the ecological field of knowledge, its epistemic and institutional setting, is still going on. This will be of central importance not only in locating ecology in the frame of 21 st century environmental sciences but also for a better understanding of how nature and culture are intertwined in debates about pressing problems, such as climate change, the protection of species diversity, or the management of renewable resources.

Since the adoption of Agenda 21 the call for more participation in environmental decisionmaking has gained in uence and prominence. This paper presents an extensive theoretical literature review as a starting point for profound scienti c research on the interrelation between collective modes of stakeholder participation and decision-making with sustainable outcomes. On the basis of literature in the elds of participatory governance, collective action theory and diverse sustainability approaches, the paper develops a research matrix with various sub-variables. In addition, the paper reviews the actor-centred institutionalist approach of Fritz Scharpf and Renate Mayntz and system theoretic approaches of David Easton and Gabriel Almond, which are then mutuallyused for designing a theoretical framework linking collective participation and decisionmaking with sustainable outcomes. The paper concludes by suggesting an application of the elaborated framework and research matrix to empirical studies.

The socio-economic activities due to world development are promoting increasing pressures on land, creating competition and conflicts, resulting in suboptimal use of resources. Integrated planning and management of land resources is a top subject of Agenda 21 (managed by FAO), which deals with the cross-sectoral aspects of decision-making for the sustainable use and development of natural resources. This is essential for life-support systems and its productive capacity. In this context, there is a need to find new strategies for sustainable development that links social and economic progress with environmental protection and enhancement. Electrokinetic transport processes (EK) uses a low-level direct current as the "cleaning agent". EK has been applied to the remediation of polluted soils and other contaminated matrices. It also shows a great potential to be used in different fields, as in saline soil restoration, nutrients recovery from wastes or repair and maintenance of building structures. EK may be an integrated approach for new strategies aiming at sustainable development and to support waste strategies, with worldwide interest. EK can also be coupled with phytoremediation and integrated with nanotechnology, enlarging the scope of its application. The conciliation of the EK in the recovery of secondary resources, remediation and conservation is a multidisciplinary novel approach that opens new technical possibilities for waste minimization, through upgrading of particulate waste products and the recovery of secondary resources for industrial, agricultural or social use.

Beside that a whole set of academic principles has been developed. Due to this developement, there a a series of principles in the Agenda 21, the Helsinki rules, Helsinki Convention and the Council of Europe. Examples of regional agreements in North America and Western and Central Europe are briefly described. As regards the EU the situation presented does not consider the European Framework Directive Water, but the situation leading to the development of of this legal framework.

In order to do so the assignment will start with the description of such a holistic conception, namely the so-called pillar-model, which comprises interlinked and interdependent dimensions or spheres of sustainable development - the economy, ecology, political institutions and social aspects. This chapter will combine the description of the model with a summary of two significant documents. Furthermore a special focus already has to be set on issues for sustainable development, that arise from multi-level systems of governance, by analyzing the competences and efforts of the European Union and the Federal Republic of Germany in the political field of sustainable politics - and the deductive obligations for Berlin. As I will demonstrate for the case of legislative principles in the European Union substantial shifts on the superordinate level may affect the local level in the implementation and the conception of one's own initiatives. Afterwards, I will present two initiatives of Berlin - Berlin's Local Agenda 21 and the Environmental Relief Programme (ERP). All of these programmes have to be put into perspective in my conclusion, whether one can talk about a genuine approach of the Land of Berlin, or if Berlin just complies with its obligations in the multi-level political system. Throughout the assignemt I will follow the assumption, that Berlin is heavily bound by systematic obligations and financial constraints. In those areas, where the city finally designs and implements programmes, it is obliged to do so and to rely on financial support to conduct the initiatives, respectively this support is a significant incentive.
